A contract offered to or intended for a condommium syndicate (syndic de copriopriété) is not aimed at consumers and any claim requesting the deletion of unfair or illicit terms contained therein is inadmissible.

A consumer association initiated a claim requesting the deletion of alledgedly unlawful or unfair terms contained in a contract offered by a real estate company to a condommium syndicate (syndic de copriopriété).

The Grenoble Court of Appeals considered that a contract entered into with a condommium syndicate (syndic de copriopriété) is not aimed to consumers. Therefore, the Court of Appeals ruled that consumer associations may not initiate claims requesting the deletion of unfair terms contained in such contracts.

The Court of Cassation confirmed the ruling of the Court of Appeals, by stating that the latter rightfully concluded that the presence of consumers among the members of the condommium syndicate (syndic de copriopriété) does not impact the admissibility of a claim requesting the deletion of illicit or unfair terms contained in a contract offered to or intended for said syndicate.
