    By applying article 1 paragraph (3) and articles 4, 5 and 6 of the Law no. 193/2000 on abusive clauses in the contracts concluded between traders and consumers (which transposes the Unfair Terms Directive 93/13) the Iasi Appeal Court, Commercial Section held that the credit contract clause providing the right of the bank to unilaterally modify the interest is abusive and ruled that the contract between the two parties should continue without it.
