    By applying article 4, article 13 para 1 of the Law no. 193 of 6 November 2000 on unfair terms in contracts between sellers and consumers (which transposes art. 2 lit. a, article 3 of the Unfair Terms Directive 93/13) the Bucharest Appellate Court held that the clauses of Law no. 193/2000 are not incidental in the case and that the claimants request to consider the contractual clauses abusive cannot be accepted. The Court also held that the defendant has complied with his contractual obligations. The court rejected the claimant’s appeal as ungrounded.
