  • Legal issue
    The judgement of the Cour d’appel states that the defendant violates the Loi du 21 avril 2004 relative à la garantie de conformité by providing a guarantee which expires prior to two years from the time of delivery. Besides, the Cour d’appel orders the defendant to pay a penalty of 100 Euro for each document/guarantee not complying with the statutory rules.
    In its reasoning the Court d’appel applied Art. 6 of the Loi du 21 avril 2004 relative à la garantie de conformité which is the transposition of Art. 5 No. 1 of the Directive 1999/44/EC of the European Parliament and of the Council of 25 May 1999 on certain aspects of the sale of consumer goods and associated guarantees.
