  • Facts
    The plaintiff is an association for consumer rights. The defendants provide telephone ser-vices and apply terms and conditions in contracts with their clients. In the plaintiff’s view the terms and conditions contain several unfair clauses and therefore infringe the Loi mo-difiée du 25 août 1983 relative à la protection juridique du consommateur. Furthermore, the plaintiff applies for the publication of the court’s decision according to Art. 5 of the Loi modifiée du 25 août 1983 relative à la protection juridique du consommateur. As the claim was considered only partially founded by the first instance, the plaintiff appealed against this judgement.
  • Legal issue
    The Cour d’appel confirms the judgement of the first instance. Some of the clauses con-tained in the terms and conditions are considered to be unfair and are declared null and void. Besides, the Cour d’appel orders the defendants to pay a penalty of 100 Euro in the event of further application of the relevant clauses. A decision on the publication of the judgement is not taken.
    The judgement applies Art. 1, 2 and 4 of the Loi modifiée du 25 août 1983 relative à la protection juridique du consommateur transposing Art. 3, 6 and 7 of the Council Direc-tive 93/13/EEC of 5 April 1993 on unfair terms in consumer contracts.
