    The advertisement of the wrong price of a product shall be regarded as a misleading commercial practice.
  • Facts
    The plaintiff intended to conclude a sale and purchase agreement of a product on the defendant’s website, for the price included in the relevant advertisements. However, the effective price of the product was approximately four times higher than the one that was advertised.
  • Legal issue
    The court has considered that the advertisement of the wrong price of a product should be regarded as a misleading commercial practice. This was based on the fact that the defendant has advertised false information, as set forth in article 6 Directive 2005/29/EC (implemented into Portuguese Law by article 7 Decree-Law No. 57/2008 of 26 March 2008).
