    The application of a misleading label on a product so as to make consumers believe that it has qualitative characteristics that in fact it does not have, is a misleading commercial practice under Article 21 of the Consumer Code.
  • Facts
    In June 2015 the consumers association Konsumer claimed before AGCM that Lidl, owner of the Primadonna brand of extra virgin olive oil, had incorrectly labelled the product at issue. The claim was based on the investigation carried out by the Italian magazine Il Test which analyzed 20 bottles of extra-virgin olive oil found in Italian supermarkets and found that 9 oils out of 20 did not come up to European extra virgin standards due to various defects.
  • Legal issue
    Based on the results of the analysis of some oil samples the product did not correspond to the category "extra virgin olive oil" according to the criteria set out by the European Regulations, but rather to the category "virgin olive oil". Therefore, provided that the product category is able to influence the commercial choices of consumers who may prefer a product characterized by higher quality characteristics (to which a higher price would correspond), the indication that the oil belongs to the extra virgin category when, in fact, the same has the characteristics of a virgin olive oil, is contrary to the trader's professional diligence and able to distort the economic behavior of the average consumer whom it reaches. Therefore, the above mentioned conduct represents a misleading commercial practice under Article 21 of the Consumer Code.
