  • Facts
    The proceedings relate to the assessment of the alleged misconduct of two separate commercial practices carried out in 2008 and 2009 by PerelAfragola and EP Italy through the preparation and dissemination of advertising leaflets.

    1. The first conduct relates to a flyer distributed by PerelAfragola in 2008, at its store branded "MediMax" in the mall "Le Porte di Napoli" containing in the first page of the main slogan written in large letters "BELOW COST", followed on the underside by the indication "promo valid from 04 to 24/07" with a smaller font and on the side of the same page an extremely reduced size graphics specifying "For products OFFERED BELOW COST, promotion valid from July 4 to July 13 2008 ".

    2. The second practice relates to the flyer distributed by PerelAfragola in 2009 having on top of the first page the main slogan written in large letters "The Maxi Summer Discounts" and in the footnotes, in a small font, the words "Promotion valid from July 8 to July 26".
  • Legal issue
    (1) The underlying indication "Promo valid from 04 to 24/07" is likely to be misleading for consumers as to the duration of promotion. As revealed by the results of the investigation, this wording was referring actually to a different promotion combined by the trader in the same leaflet. Without this combination the information would have been clearly specified and sufficiently clear. The graphics adopted by the trader is not sufficient to clarify to the consumer the duration of the promotion

    (2) No misleading profiles were found in the second practice because the leaflet still indicated the promotional offer period, albeit with characters that did not have similar graphical evidence.
