    Based on several complaints, AGCM investigated on the conducts carried out by the trader on its website and its summer catalog consisting of the dissemination of incomplete and contradictory commercial information with respect to the final price charged to join its cruises and to limitations imposed for the exercise of consumers' contractual rights. In particular on its websites the company would have promoted prices which were not including additional charges later added during the booking procedure and resulting in significant differences between the initial amount advertised on the home page and those actually required to passengers at the time of purchase. Moreover, the company omitted certain information, essential for buyers, concerning the possibility of exercise their contractual rights such as the right of withdrawal or redemption.
  • Legal issue
    The conducts carried out by MSC were considered misleading and omissive provided that the price shall be immediately intelligible and easily quantifiable for the purpose of proper and immediate cognition by the consumer of the total cost of the cruise services advertised and the exercise of contractual rights for consumers shall not be unjustifiably limited. The practices in question were also incorrect even under the professional diligence.
