  • Facts
    The plaintiffs are a married couple who bought real estate from the defendant, a real es-tate broker representing the owner of the property. The contract was signed by an em-ployee of the real estate broker who did not have power of representation. Furthermore, the contract was concluded on the suspensive condition of the approval by the owner of the property. Invoking the invalidity of the contract with the plaintiffs the defendant sold the property to a third party. The plaintiffs argue that the clause stating the condition of approval by the owner was in effect a potestative condition and therefore violates Art. 1 of the Loi modifiée du 25 août 1983 relative à la protection juridique du consommateur.
