    Transposición de la Directiva (UE) 2015/2302, relativa a los viajes combinados y a los servicios de viaje vinculados. Real Decreto-Ley 23/2018, de 21 de diciembre. Posibles implicaciones prácticas.

    On 21 December 2018, the Royal Decree-Act 23/2018 of 21 December was enacted, which among other EU Directives, incorporates into Spanish law the Directive (EU) 2015/2302 of the European Parliament and of the Council of 25 November 2015 on package travel and linked travel arrangements.  The purpose of this Directive is to harmonise and approximate the existing laws, regulations, and administrative provisions of the Member States in order to contribute to the proper functioning of the internal market and to achieve a higher level of traveller protection, taking into consideration the market developments (new ways of combining travel services, the Internet…) and the need to enhance transparency and to increase legal certainty.

    This articles analyses in a concise manner the most relevant changes introduced by the Royal Decree-Act, as well as its possible implications and practical consequences for consumers, organisers, retailers, and travel service providers.

    Therefore, this article aims to study lege ferenda law adopted by the European Commission in this matter and the papers written by academics on the state of this issue in the different Member States to assess the state of the Spanish procedural law before the possible adoption of a European Directive that establishes a uniform regulation for all the Member States.
