    (1) A consumer’s right of revocation for a contract for the supply of digital content not on a physical medium shall expire if the contractor, first, has commenced the execution of the contract after the consumer expressly consented to the contractor being obliged to comply with the contract before expiry of the contract and, secondly, has confirmed his knowledge that he will lose his right of withdrawal by his consent at the beginning of the execution.
  • Sachverhalt
    The plaintiff is a consumer association. The defendant is the largest domestic provider of pay television. Customers can book the "Sky Online" offer as part of a subscription contract. This can be terminated on a monthly basis, but is always extended if not terminated effectively. "Sky Online" allows both internet-based access to an online video library and access to real-time TV channels.

    A consumer had registered at the beginning of April 2015 via the website of the defendant at "Sky Online". After the conclusion of the subscription agreement, the customer received an e-mail with the access data. In the e-mail, the following continued: "By clicking on the link, you immediately receive a personal access authorization (S. PIN) and access to the contents of S. Online. By clicking, you agree to S. before the end of the revocation period of the contract. You will lose your right of withdrawal upon commencement of the contract. " The customer revoked the contract a few days after concluding it. Sky rejected the withdrawal and argued that the right of revocation had already been extinguished since the execution of the contract had already begun.

  • Entscheidung

    The court held that a reduction of the usual 14-day right of revocation pursuant to § 355 para. 2 BGB is permissible if the contract refers to a longer-term subscription and the consumer activates the contract before expiry of the revocation period.
