  • Sachverhalt
    The plaintiff and defendant are both media owners, editors and publishers of periodic publications (free newspapers), the distribution areas of which slightly overlap. The defendant's publications include paid advertisements but also a high share of editorial articles, the content of which is often related to the paid advertisement.

  • Entscheidung

    The court held that there is no explicit legal obligation to mark free advertisements in editorial articles of periodic media. Regardless of this, the court held that if a newspaper recommends a specific company in an editorial article, this could be deemed a misleading practice. Furthermore, the court came to the conclusion that an average interested and critical reader would no longer believe that editorial articles in periodic media are neutral and have absolute objectivity, as they are written by journalists who include their personal opinion. If an average reader has no doubts regarding the character of a publication to be an editorial article, even in the case of a free article, no additional information is required. This is also the case if the article includes statements with a commercial character.Therefore, the court found the cease-and-desist order to be unjustified.
