The author first describes how Directive 90/314 regulates the liability of intermediary travel agencies in case of bankruptcy of a tour operator. Thereafter follows a brief description of the implementation of Directive 90/314 into Austrian law and a comprehensive elaboration of scenarios in which the travel agency will be liable. The author also discusses the German case law and describes the different implementation in Germany.
