Keine Negativverzinsung beim Verbraucherkreditvertrag.

This article discusses the decision of the Supreme Court of 21. 03. 2017 (case nr. 10 Ob 13/17k). The question before the Court was who is entitled to negative interest from a credit agreement between a consumer and a seller. The particularities of the provision article 28a Abs 1 KSchG is analysed in detail. This provision serves to implement Directive 2009/22/EC.
