Numerous questions on the statute of limitations of repayment claims from consumer credit agreements were recently submitted to the ECJ. The article deals with the consequences that the ECJ's case law has on Austrian law. The focus is on the question of whether the Austrian legal situation complies with the Directive and what an interpretation in conformity with the Directive might look like.
