Does the Tourism Code meet the needs of the travel industry? The debate has been agitating the industry since the adoption of the law of 13 July 1992 and the introduction of the principle of the full liability of travel agencies. In the light of the Covid-19 crisis, criticism of the overtly consumerist provisions is as strong as ever. The Tourism Code is totally disconnected from the realities of this key sector of the French economy, as it mainly responds to the needs of travellers-consumers. The stated objective of Brussels, which is behind the directives that founded the French regulations, is to confer a certain number of important rights on consumers in the field of package travel (information obligations, liability of professionals and protection in the event of their insolvency). And even though the Directive of 2015 states that it aims 'to increase legal certainty in favour of travellers and professionals, while taking account of the evolution of the market’, it ends up above all reinforcing consumer protection.
