The author explains the distinction between the commercial practices deemed to be misleading in all circumstances (black list) and the commercial practices that are qualified as misleading according to the circumstances. 

 

On these two issues, he compares the provisions of the UCP Directive (in light of the “Working staff document – guidance on the implement / application of Directive 2005/29/CE on unfair commercial practices” issued by the European commission) with the provisions of French law implementing the UCP Directive.
