The authors question whether the prohibition of unfair commercial practices in general is autonomous and can be distinguished from aggressive and misleading commercial practices. 

They consider that unfair commercial practices are in fact prohibited as such, however, they note that the national implementation provisions in the French Consumer Code do not provide for specific sanctions.
