This paper intends to analyse the new role of the diligence criterion in the light of the introduction of the obligation for a bank to assess the creditworthiness of the consumer. In particular, the contribution focuses on the civil consequences of the non-fulfilment of the aforementioned "creditworthiness" evaluation.
