    The author analyses Directive 2011/83 / EU. With this Directive, the European legislator intervened to strengthen the system of safeguards to the electronic consumer through an approach of maximum harmonisation, preventing Member States from adopting internal regulatory solutions that differ from those indicated in the Community text. In line with this approach, the Directive aims to reorganise, in an organic and systematic way, the rules common to contracts negotiated away from business premises and to those relating to distance contracts in a single set of legislation in order to encourage cross-border commercial exchanges and reduce transaction costs for consumers and businesses
