It is not necessary to explicitly note the unlimited risk in foreign currency-based credit agreements towards the consumer, as long as the consumer understands that the exchange rate may fluctuate and this can have serious consequences on their obligations.

  • Tények

The respondent, as debtor, signed a foreign currency-based credit agreement with the plaintiff’s legal predecessor, a bank. On the day the agreement was signed, the respondent also signed a statement that they have read the risk information provided by the bank. This information notably contained an example relating to currency exchange rate fluctuation, and a display table.

  • Jogi kérdés

Whether the agreement contained unfair terms as it did not explicitly mention the unlimited risk?

  • Határozat

The Supreme Court held that it is not necessary to explicitly include the terms “unlimited” or “without upper limit” when informing the consumer regarding currency exchange rate fluctuation-derived risk, as long as the consumer was informed not only about how the exchange rate may fluctuate, but also about how this can have potentially serious consequences on their debt obligations. The Supreme Court found that considering the contents of the risk information document, especially noting its use of examples and tables, the bank fulfilled these requirements.
