    The plaintiffs signed a foreign currency-based credit agreement with the legal predecessor of the respondent, a bank. As part of this contract, the plaintiffs agreed to bear the risk arising from potential currency exchange rate fluctuation. Furthermore, after the contract’s signature, the plaintiffs separately signed the risk information documented presented by the bank in front of two witnesses. The dispute arose from the plaintiffs refusing to pay instalments.

    The Supreme Court took the position that in order to determine whether the risk transfer constituted an unfair term, the court must examine both the risk information document and the related credit agreement’s relevant provisions. In this case, the Supreme Court found that the risk information was not sufficient: it did not draw the consumer’s attention to the possible level of risk in an explicit enough manner, and instead merely stated that the interest rate is strongly dependent on the currency exchange rate. As such, it was neither clear nor understandable for the consumer.
