    One of the plaintiffs signed a credit agreement with the respondent, with the other plaintiff serving as the guarantor. The agreement was credit based on foreign currency. In the risk information document, which the plaintiff signed as having received, the respondent noted that the interest rate is more favourable for the plaintiff in this construction, unlike a purely HUF-based credit agreement. However, the document also contained information regarding the risk of fluctuation and illustrated it with examples. The dispute developed after the first plaintiff failed to pay their instalments.

    The Supreme Court noted that while the risk information provisions inserted into the contract in themselves do not fulfil the legal requirements of information, the separate risk information document which the plaintiff received does meet those requirements. It included the information that the exchange rate may develop unfavourably for the consumer and that this risk is borne by the debtor. The Supreme Court also highlighted the presence of illustrative examples in this document. As such, the given provisions were not to be deemed unfair terms.
