    When it comes to advertising, the consumer’s perspective should be taken into consideration, and misleading advertising can occur regardless of the understanding or intent of the service provider.

    The plaintiff was a mobile service provider who advertised itself as having the largest “European 4G partner network”. The Consumer Protection Authority took issue with this statement as it considered it misleading and fined the plaintiff. The dispute thereafter developed into a court case.

    The Supreme Court agreed with the lower courts and the respondent Authority that the terms used by the plaintiff would indicate geographical coverage, not number of partners, further reinforced by how the former is the more relevant information for the consumer, while the latter is not. Furthermore, the Supreme Court also noted that the plaintiff is not excused by the fact that the consumers would have received factually correct information during the process of signing the contract with the plaintiff.
