    The Defendants sold perfumes in their stores by comparative reference to the registered trademarks owned by the Plaintiffs, namely using comparative lists, made available to the public or for the mere consultation of store employees, available at store counters or on the computers. The commercial method adopted by the Defendants was, therefore, based on the sale and promotion of their products, exclusively through their association with registered trademarks, including the registered trademarks of the Plaintiffs, thus aiming at an illicit use of the image that they enjoy in the market, namely through its registered trademarks, thus resulting in the violation of the exclusivity that the respective registrations guarantee.

    How can the court access the unfairness of an act based on a general clause?

  • Decisão

    The existent general clause makes the assessment of the act's unfairness dependent on the sensitivity of the judge, allowing for some poorly defined and definitive areas. However, there are some advantages, namely, due to the flexibility to adapt the concept of unfair competition to the multiple situations that, at each moment and in each sector of activity, are considered contrary to the honest norms and uses, appealing to a general ethical control of social standards of conduct that allows to draw the dividing line between what is fair and unfair.
