  • Fatti
Defendants were arraigned by the police after officials from the Consumer Affairs Department inspected the shop operated by defendants and , particularly in the shop window, there were no price indications for the goods for sale.
  • Kwistjonijiet legali
Must objects being placed for sale have a clear indication of price?
  • Deċiżjoni

The court concluded that not all the goods for sale satisfied the requirements of Legal Notice 283 of 2002 (which implements Directive 98/6 into Maltese law). It noted that it found it hard to believe that every time the office from the Consumer Affairs Department made an inspection, the sales girl or the owner were in the process of pricing the goods. It therefore found that the prosecution had proven its case.
