  • Περίληψη
    According to Directive 2005/29/EC (recital 15), Member States are able to maintain or introduce more stringent provisions in conformity with Community law in order to ensure a higher level of protection of consumers' individual contractual rights.

    The plaintiffs – several weight control / fitness clubs - filed against the adoption of the Ministerial Decision that has laid down the rules regarding the specific type and the terms of the contracts signed between consumers and weight control / fitness clubs. In specific this Decision had set up the minimum information that should be provided to the consumers, established the right of withdrawal from such contracts, stipulated the term and termination rules, and laid down specific penalties. The plaintiffs requested the cancellation of that Ministerial Decision on the grounds that –inter alia- its content was not part of the Unfair Contract Practices Directive and that it exceeded the provisions set in it.

  • Απόφαση

    The court ruled that the provisions of the contested decision are rules of domestic law which do not reproduce the provisions of the Directive on unfair commercial practices. Thus, the court rejected the plaintiffs’ plea for cancelation of the specific Ministerial Decision, since, moreover, that Directive does not prevent the national legislator to adopt extra more stringent provisions in favour of the consumers.
