The purpose of this study is the critical approach of judgement no. 4/2019 of the Greek Supreme Court in plenary. With this judgement, the conclusion of a legal and economic drama was written, which has ‘tormented’ the branches of civil and banking law for the past five years. The unprecedented division of legal theory and case law concerning the issue of loan agreements in Swiss franc takes another dimension after the judgement of the Supreme Court, which insisted on the declaratory character of the contested general contractual term relating to exchange rates.
