In the article the author analyses several problem points in regard to the interpretation of off-premises contracts. Inter alia, the author gives an in-depth analysis of the notion “place which is not the business premises”. She proposes three independent features that describe the place which is not the business premises. Namely: (i) the place where the trader provides services or sells goods is not unequivocally identifiable as a place where goods are sold or services are provided to the public; (ii) the consumer may not purchase the goods or obtain the service, if the trader has not individually invited the consumer or the consumer is not the trader’s regular client; (iii) when arriving at the place where goods are sold or services are provided the consumer is surprised or meets psychological pressure. In the article the author also elaborates on the notion of “business premises”.
