Krediti v švicarskih frankih po ustalitvi sodne prakse pred Vrhovnim sodiščem.
In the article, the author presents the issue of consumer credits pegged to Swiss francs. He provides an analysis of the case law of Slovenian courts, especially of the Supreme Court of the Republic of Slovenia, and such case law of the CJEU. It pays particular attention to the treatment of precontractual explanatory duty in EU law and the related issue of consumer treatment. He points out that Slovenian practice is more in favour of the subjective criterion, while EU practice is based on an objective criterion - the legal standard of the average consumer.
