The Sale of Goods Directive and its Dutch transposition are concerned with the subjects of the guarantee, the reversal of the burden of proof in the event of non-conformity, and remedies for the necessary improvements or clarifications. The most striking aspect is perhaps the permissibility of the use of the English language in guarantee certificates. However, both the Directive and the Dutch transposition also create ambiguities. Moreover, the European Commission and the Council could have paid more attention to the remedies available in the event of non-conformity from the viewpoint of environmental sustainability.
