    The author critically assesses the concept of business premises in the Consumer Rights Directive in the light of its European and Belgian genesis. The level of consumer protection in the case of off-premises contracts is evaluated by also taking into account the recent developments in the case law of the ECJ. The author argues that consumers are less protected when contracting at stands at sales fairs than hitherto was the case. The ECJ seems to broaden the concept of business premises and to give a pivotal role to national judges and their assessment of what average European consumers may normally expect at such fairs.
