    A purchaser, subject to the average consumer standard, should not be required in each case to read the information in the advertising publication; it sufficient for him to read the information published next to the product being sold.

    A supermarket chain “IKI”, owned by UAB “Palink” had a promotion during which customers had the opportunity to purchase Grite toilet paper products with a 50 percent discount. A consumer tried to buy 28 packs of toilet paper and found out that the discount was only valid when buying not more than 10 units of Grite production. The consumer wrote a complaint to the State Consumer Rights Protection Authority which fined UAB “Palink” for unfair commercial practices. The company appealed the ruling.

    The First Instance Court upheld part of the action lowering the fine from EUR 11 000 to EUR 9000 and dismissed the rest of the action.

    Should a purchaser, subject to the average consumer standard, be required in each case to read to the information in the advertising publication, or is it sufficient for him to read the information published next to the product being sold?

  • Sprendimas

    A buyer, having purchased 28 packs of toilet paper, expected a 50 percent discount of the total amount because the information board next to the product did not indicate any restrictions on the quantity of goods to be purchased. A buyer to whom the average consumer standard applies cannot be required to be acquainted with the information in the advertising publication "Savaitėlė" in each case, as it is sufficient for him to be acquainted with the information published next to the product being sold. The concept of the average consumer is related to the perception of the information received, not the ability to receive it.
