  • Fakty

    The plaintiff ran three pubs. The defendant was the owner of a website dealing with beer and pubs. It was possible to post information about pubs and beer on the portal for promotion. The defendant carried out two types of promotional activities: a free-of-charge standard package or a paid extra package. The plaintiff used a paid service for some time, however, after its expiration, the description of his pubs was changed to a free version. As a result, changes in the defendant's profiles presenting individual premises were introduced, in particular, the lists of beers on offer were removed and the new content of the descriptions was included. This included testimonials and opinions of clients which were not praising pubs ran by the plaintiff, however, they were true. The plaintiff had the opportunity to access his profiles and change descriptions, because the defendant had provided him with logins at the beginning of the cooperation, but he did not use this option. The plaintiff considered the above descriptions to disavow the real value of its premises and considered them acts of unfair competition.
