Lawyers must inform their clients in advance of their fee calculation method. Lawyers’ fees are not subject to VAT in Belgium.
Fixed costs for litigants in civil proceedings

In some cases, when the applicant or the intervening party in the proceedings is not Belgian and the respondent is Belgian, the latter may, in the absence of an international agreement providing for dispensation and except in special circumstances, request that the applicant or the intervening party provide surety to guarantee payment of damages arising from the action. This is provided for in Article 851 of the Judicial Code.
The costs of bailiffs and lawyers (see above) and translators and interpreters (see below) must also be taken into account, as appropriate.
Stage in civil proceedings when a party must settle fixed costs
Some costs must be settled before an action is brought. This applies to the registry fee, which is collected when the case is entered in the register.
Costs arising during the proceedings are generally collected while the proceedings are underway.
For some costs a reserve has to be established. In this way, experts are paid from a reserve established by the party that sought the measure of inquiry. Likewise, Article 953 states that the party requesting that a witness be heard must, before such hearing, deposit a reserve with the registrar representing the amount of the allowance and the reimbursement of costs (travel, etc.).
Costs in legal proceedings are sometimes advanced by lawyers and therefore included in their statement of costs and fees.
Fixed costs due from all parties in criminal proceedings
The issue of fixed costs in criminal proceedings is regulated under Article 91 et seq. of the Royal Decree of 28 December 1950.
Variable costs in criminal proceedings
If the victim files a complaint with an application to join proceedings as a civil party with the investigating judge (Article 66 of the Code of Criminal Procedure), the latter has the option to request that the victim deposit a certain amount of money with the registrar of the court. If the complaint is admissible and well founded, the surety will be refunded.
Stage in criminal proceedings when a party must settle fixed costs

They may, depending on their degree of insolvency, be exempted, in full or in part, from paying the costs of bailiffs, experts, etc. This matter is governed by Article 664 et seq. of the Judicial Code.

Tapaus B – Rajat ylittävä tilanne: Saman jäsenvaltion (jäsenvaltio A) kansalaiset menevät keskenään naimisiin. Avioliitto solmitaan jäsenvaltiossa A. Häiden jälkeen pariskunta muuttaa asumaan ja työskentelemään toiseen jäsenvaltioon (jäsenvaltio B), josta tulee heidän kotipaikkansa. Pian tämän jälkeen pariskunta muuttaa erilleen: vaimo palaa jäsenvaltioon A ja aviomies jää jäsenvaltioon B. He päättävät erota. Palattuaan jäsenvaltioon A vaimo hakee välittömästi avioeroa jäsenvaltion B tuomioistuimelta.
Tärkeä alustava huomautus: Belgiassa ei säännellä asianajajien kuluja ja palkkioita (ne määräytyvät asian vaikeuden ja merkityksen mukaan, ja lisäksi niihin vaikuttavat asianajajan nimekkyys ja maine, asian kiireellisyys, asian ratkaisu jne.). Asianajajia sitovat kuitenkin myös Belgiassa eettiset säännöt, ja heillä on lakisääteinen velvollisuus arvioida kustannukset ja palkkiot kohtuuden rajoissa (ks. edellä).

Tässä perheoikeutta – lasten huoltajuutta – koskevassa tapauksessa jäsenvaltioita pyydettiin antamaan hakijoille neuvoa oikeudenkäyntikuluista seuraavissa tilanteissa:
Tapaus A – Kotimainen tilanne: Pariskunta on asunut yhdessä useita vuosia menemättä naimisiin. Erilleen muuttaessaan heillä on kolmivuotias lapsi. Tuomioistuin määrää lapsen huoltajuuden äidille ja myöntää isälle tapaamisoikeuden. Äiti nostaa tuomioistuimessa kanteen isän tapaamisoikeuden rajoittamiseksi.
Tapaus B – Rajat ylittävä tilanne jäsenvaltiossa A toimivan lakimiehen kannalta: Pariskunta on asunut yhdessä jäsenvaltiossa B useita vuosia menemättä naimisiin. He saavat yhteisen lapsen, mutta muuttavat erilleen heti tämän synnyttyä. Jäsenvaltion B tuomioistuin määrää lapsen huoltajuuden äidille ja myöntää isälle tapaamisoikeuden. Äiti ja lapsi muuttavat asumaan jäsenvaltioon A, mihin heillä on tuomioistuimen päätöksen mukaan oikeus, ja isä jää asumaan jäsenvaltioon B. Muutaman vuoden kuluttua äiti nostaa kanteen jäsenvaltion A tuomioistuimessa isän tapaamisoikeuden muuttamiseksi.
Tärkeä alustava huomautus: Belgiassa ei säännellä asianajajien kuluja ja palkkioita (ne määräytyvät asian vaikeuden ja merkityksen mukaan, ja lisäksi niihin vaikuttavat asianajajan nimekkyys ja maine, asian kiireellisyys, asian ratkaisu jne.). Asianajajia sitovat kuitenkin myös Belgiassa eettiset säännöt, ja heillä on lakisääteinen velvollisuus arvioida kustannukset ja palkkiot kohtuuden rajoissa (ks. edellä).

Tapaus A – Kotimainen tilanne: Pariskunta on asunut yhdessä useita vuosia menemättä naimisiin. Erilleen muuttaessaan heillä on kolmivuotias lapsi. Tuomioistuin määrää lapsen huoltajuuden äidille. Ainoa ratkaisematon erimielisyys koskee sitä, minkä verran elatusapua isän on maksettava äidille lapsen huoltoa ja koulutusta varten. Äiti vie asian oikeuteen.
Tapaus B – Rajat ylittävä tilanne jäsenvaltiossa A toimivan asianajajan kannalta: Pariskunta on asunut yhdessä jäsenvaltiossa B useita vuosia menemättä naimisiin. Erilleen muuttaessaan heillä on kolmivuotias lapsi. Jäsenvaltion B tuomioistuin määrää lapsen huoltajuuden äidille. Isän suostumuksella äiti ja lapsi muuttavat asumaan toiseen jäsenvaltioon (jäsenvaltio A), josta tulee heidän kotipaikkansa.
Ainoa ratkaisematon erimielisyys koskee sitä, minkä verran elatusapua isän on maksettava äidille lapsen huoltoa ja koulutusta varten. Äiti vie asian oikeuteen jäsenvaltiossa A.

Tässä kauppaoikeutta – sopimusoikeutta – koskevassa tapauksessa jäsenvaltioita pyydettiin antamaan myyjälle neuvoa oikeudenkäyntikuluista seuraavissa tilanteissa:
Tapaus A – Kotimainen tilanne: Yritys toimitti ostajalle tavaroita 20 000 euron arvosta. Myyjä ei saanut niistä maksua, koska ostaja katsoi, että tavarat eivät vastaa sovittua.
Myyjä päättää nostaa kanteen saadakseen täyden kauppahinnan.
Tapaus B – Rajat ylittävä tilanne: Yritys, jonka kotipaikka on jäsenvaltiossa B, toimittaa 20 000 euron arvosta tavaraa jäsenvaltiossa A olevalle ostajalle. Sopimukseen sovelletaan jäsenvaltion B lainsäädäntöä, ja sopimus on laadittu jäsenvaltion B kielellä. Myyjä ei ole saanut maksua, koska jäsenvaltiossa A oleva ostaja katsoo, ettei tavara ole sopimuksen mukaista. Myyjä päättää nostaa kanteen jäsenvaltiossa A saadakseen maksun ostajan kanssa tehdyssä sopimuksessa määritetystä täydestä hinnasta.

Tässä kauppaoikeutta – vahingonvastuuta – koskevassa tapauksessa jäsenvaltioita pyydettiin antamaan asiakkaalle neuvoa oikeudenkäyntikuluista seuraavissa tilanteissa:
Tapaus A – Kotimainen tilanne: Lämmityslaitevalmistaja toimittaa lämmityslaitteen asentajalle. Asentaja myy lämmityslaitteen asiakkaalleen tämän kotiin asennettavaksi ja asentaa laitteen paikoilleen. Pian tämän jälkeen talossa syttyy tulipalo. Kaikilla osapuolilla (laitevalmistaja, asentaja ja asiakas) on vakuutus. Tulipalon alkuperä on kiistanalainen. Kukaan ei halua korvata asiakkaan vahinkoa.
Asiakas päättää nostaa kanteen ja vaatia täyttä korvausta lämmityslaitevalmistajalta, lämmityslaitteen asentajalta ja vakuutusyhtiöiltä.
Tapaus B – Rajat ylittävä tilanne: Jäsenvaltiossa B oleva lämmityslaitevalmistaja toimittaa lämmittimen jäsenvaltiossa C sijaitsevalle asentajalle. Asentaja myy lämmityslaitteen asiakkaalleen tämän kotiin asennettavaksi ja asentaa laitteen paikoilleen jäsenvaltiossa A. Pian tämän jälkeen talossa syttyy tulipalo. Kaikilla osapuolella (laitevalmistaja, asentaja ja asiakas) on omassa jäsenvaltiossaan olevan vakuutusyhtiön vakuutus. Tulipalon alkuperä on kiistanalainen. Kukaan ei halua korvata asiakkaan vahinkoa.
