    The question was whether the fellow passengers (the other beneficiaries) were the persons liable to pay the tour price under a travel contract which they had not signed.

    There is no doubt that civil law entities may also enter into a contract for the benefit of a third party (contractus in favorem tertii) by which the debtor (prominent ) commits to the creditor(s) acting in his own name to fulfil to the third party (tertiary); still, this contract is concluded without the participation of this third party. If a third party agrees to accept the subject of performance (by expressed or implied act), they have the right to claim the performance from the debtor. If a contract is concluded for the benefit of the third party, the third party's right to performance under the contract agreed in his favour is based upon him. The fact that the creditor entered into a travel contract in his own name means that all obligations related to the fulfilment of the contract lie upon him (namely the payment of the price of the "tour") and does not fall on third parties.
