    The Government proposes legislative amendments to implement Directive (EU) 2019/2161 of the European Parliament and of the Council amending Council Directive 93/13/EEC and Directive 98/6/EC of the European Parliament and of the Council, 2005/29/EC and 2011/83/EU as regards better enforcement and modernisation of the Union's consumer protection rules.

    The proposals modernise and adapt to the increased digitalisation. It must be clear whether the person offering a product for sale on an online marketplace is a trader or not. Further information is required on the main criteria that determine ranking of digitally presented products and how this is to ensure that consumer reviews come from consumers. The proposals also require that if a product is offered with the indication that the price has been reduced, the previous price must be indicated. It is proposed that the scope of the Distance Contracts Act is adjusted to cover contracts that involve payment obligations and certain cases where personal data is provided. The trader's obligation to provide information to the consumer prior to the conclusion of a contract is extended. Certain provisions on the right of withdrawal in the Distance Contracts Act are also proposed to be amended, including those in relation to digital content and services and repairs that have been completed.

    In addition, the Government proposes to extend the possibilities for imposing a market disruption levy and to introduce the possibility of imposing a trader to pay a penalty for infringement of the law on contractual terms. The aim is to protect consumers against serious infringements of the consumer protection rules.

    The legislative amendments are proposed to enter into force on 1 July 2022.
