    County Court Košice 2 held civil proceedings in the case of the plaintiff EOS KSI Slovakia, s.r.o. against the defendant. The case was brought before the court on 5 November 2013 and one of the claims raised in the lawsuit became payable on 2 November 2010.

    County Court pointed out that according to the articles 100 and 101 of the Civil Code the limitation period has expired, and this claim cannot be adjudicated if the debtor invokes such limitation as his defense. Article 5 letter b) of Consumer Protection Act states that “Even without a proposal regarding impossibility to exercise the right, the body which makes decisions on claims related to the consumer contract shall consider weakening the seller´s claim towards the consumer, including its expiration or a different legal obstacle or a lawful reason which makes it impossible to apply or to acknowledge performance of the seller towards the customer, even if it was otherwise necessary for the consumer to appeal to such matters.".

    Legal issue of the matter was to assess whether the duty of the court ex officio to take into account the limitation period of consumer credit is in accordance with article 46, paragraph 1, of the Constitution guaranteeing the right to an impartial court, the right to the judicial protection and the right of access to the Court in conjunction with the legal certainty which is guaranteed by article 46 paragraph 1 of the Constitution as well as article 1, paragraph 1,of the Constitution.

  • Rozhodnutie

    Article 5 letter b) of the Act No. 250/2007 Coll. on consumer protection does not comply with article 46, paragraph 1 and article 1 paragraph 1 of the Constitution of Slovak Republic.

    The article 5 letter b) (Act No. 250/2007 Coll.) states: “Even without a proposal regarding impossibility to exercise the right, the body which makes decisions on claims related to the consumer contract shall consider weakening the seller´s claim towards the consumer, including its expiration or a different legal obstacle or a lawful reason which makes it impossible to apply or to acknowledge performance of the seller towards the customer, even if it was otherwise necessary for the consumer to appeal to such matters."
