    The fact that information, whether a toner printed up to 1000 pages when the coverage is 5% represents material information that the average consumer needs in order to take an informed transactional decision. The failure of the trader to provide this information on the label of the product qualifies as misleading omission within the meaning of Directive 2005/29/EC.

    The plaintiff offered for sale consumable for multifunctional device Samsung S LM 2070/SEE, namely Samsung Toner MLT – D1115/ELS without a label in Bulgarian. Hereby, the users are not granted with essential information that the toner printed up to 1000 pages per 5% page coverage.

    The Consumer Protection Commission issued an order establishing that the plaintiff used unfair commercial practice because essential product information was withheld from consumers which were, in this way, misled while taking a transactional decision. The plaintiff appealed this order before Sofia Administrative Court but the Court rejected the appeal as ungrounded. As a final resort, the plaintiff appealed the First Instance Court’s judgement before the Supreme Administrative Court.

    The Supreme Administrative Court held that:

    The trader has not explicitly indicated on the label in Bulgarian the information that the toner supply has the capacity to print up to 1000 pages when the page coverage is 5%. In this way, the trader has misled consumers that the toner can print up to 1,000 pages without any limit on the area of the printed pages.

    This product information is essential and therefore its lack of accuracy can significantly change the consumer's economic behaviour.
