The tour operator is responsible for the presence of the minimum mandatory content in the contract for organised tourist travel, regardless of whether it concludes the contract directly with the traveller or uses the mediation of a travel agent.

Consumer Protection Commission imposes a property sanction on a tour operator for the fact that the contract concluded with the traveller lacks part of the statutory content - personal data of the traveller, type of transport used, starting point, time and place of departure, expected time of arrival, location of the accommodation, type and category of restaurants and others.

The tour operator objects to the imposed sanction, arguing that the fault for the missing content of the contract lies with the travel agent through whom the contract was concluded.

Can a tour operator be acquitted of missing mandatory content in the travel package contract because the reason for the omission is due to the actions of the travel agent?

The Court considers that the Consumer Protection Commission has lawfully sanctioned the tour operator for missing part of the mandatory content of the contract for a travel package, despite the fact that the travel agent may be to blame for the omission, as in this type of contract the travel agent always acts in the name and at the expense of the tour operator.
