The article deals with the application of the criterion of economic behaviour of the average consumer in the assessment of unfair commercial practices under Directive 2005/29 / EC.
It is based on the premise according to which the specific behaviour of that model consumer (in the cases under consideration) is not to be inferred from the statistical findings made but is to be determined at the discretion of the administrative or judicial authority.
